AFFILIATE AGREEMENT
This agreement describes the terms and conditions for participation in the LasVegasTickets.com affiliate program. In this agreement, the term “Affiliate” refers to you (the applicant). In this agreement, “LVT” refers to LasVegasTickets.com, a Nevada Corporation, with whom you are entering this agreement. By applying to the ‘LVT’ affiliate program, you are confirming that you have read the agreement and agree to the Affiliate Program and Terms and Conditions.
(1) AFFILIATE PROGRAMS
Travel Agency Affiliate Program for any sized Travel Agency in the United States and Internationally. Note: You cannot recruit your own affiliates.
(2) UNACCEPTABLE WEBSITES
An affiliate will be removed or declined from a program if said affiliate link to or include content that:
(3) COMMISSIONS
For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product. Commissions will only be paid on sales that are made when the customer’s payment has been accepted in full. Properly coded links are the sole responsibility of the affiliate when using links, banners, tiles. Commissions can be viewed on the Affiliate Dashboard.
(4) PAYMENT
An Affiliate will receive payment(s) the month following when the actual event occurred. Payments are received in the form of a check.
(5) REFUNDS
A: There are NO REFUNDS or EXCHANGES ON ANY TICKET SALE UNLESS THE EVENT HAS BEEN CANCELLED AND NOT RESCHEULED.
(6) USAGE AND OBLIGATIONS
Affiliates are permitted to use the LasVegasTickets.com brand and marketing resources available in the Affiliates section of the LasVegasTickets.com application. Logos and other assets cannot be modified. The Affiliate does not gain any trademark, copyright or any other rights to these materials.
The Affiliate will never imply that they are acting on behalf of LasVegasTickets.com and will never advertise LasVegasTickets.com products directly. The Affiliate will never bid for advertisements that compete with LasVegasTickets.com.
The Affiliate will never represent themselves, LasVegasTickets.com or their relationship with LasVegasTickets.com in a false or misleading way. The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing LasVegasTickets.com.
TERMS AND CONDITIONS
Either party has the right to terminate the agreement immediately without prior notice.
If the Affiliate terminates the agreement, all prior sales will paid according to Section #4 – Payments, in the Affiliate Agreement. If “LVT” chooses to terminate the agreement, any balance owed will be paid by the 10th of the following month.
PROGRAM REQUIREMENTS
Travel Agency: No minimum monthly sales requirements (Must meet conditions of “Unacceptable Websites” Section 2)
TERMINATION COMMUNICATION
Both Affiliate and ‘LVT’ agree that any termination must be communicated via email. For Affiliate termination, please send all termination notices to: [email protected]. Upon receipt of termination notice by affiliate, all prior sales will paid according to #4 Payments, in the Affiliate Agreement.
GOVERNING LAW
This Agreement shall be governed, construed, and enforced in accordance with the laws of the State of Nevada, without regard to its conflict of laws rules.
ARBITRATION
All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the State of Nevada. An award of arbitration may be confirmed in a court of competent jurisdiction.
MODIFICATION
We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of commission schedules, payment procedures and Affiliate Program rules.
